REGULATION – CERTIFICATE OF PRACTICE /LICENSE


CERTIFICATE OF PRACTICE

Regulation: The purpose of this regulation is to ensure the proper usage of the tile of “Optician” and to protect the public by ensuring that all opticianry services are provided by a licensed Optician.

Procedure: In keeping with the Province of Manitoba’s Opticians’ Act and the bylaws of the Opticians of Manitoba ,the registrar must issue a Certificate of Practice/License to a member who applies for it and whose name is entered on the register of regulated members if all of the following are satisfied:

  1. the member’s registration is not suspended or cancelled;
  2. the member meets any requirements for maintenance of competence that are established by

OOM policy and bylaws;

  1. the member provides evidence of having a minimum of one million dollars $1,000,000 in Errors and Omissions Professional  liability insurance or coverage as required by OOM policy and bylaws;
  2. the member has paid the licensing fees provided for in the OOM by-laws;
  3. the member provides the registrar with any other information that the OOM polices/bylaws require,
  4. the member meets any other requirements set out in the OOM policies/bylaws for licensing.

Conditions

A Certificate of Practice/License may be issued subject to any conditions that the registrar considers advisable.

Information to be shown on Certificate of Practice/License

The Certificate of Practice/License must include:

  1. the name of the regulated member;
  2. the class of regulated membership, as the Opticians of Manitoba has more than one class of regulated   members;
  3. any conditions imposed on the regulated member’s practice;
  4. the name of the Opticians of Manitoba as the regulatory body that is issuing the certificate/license, and the date it is issued;
  5. a statement that the certificate of practice is issued pursuant to the Province of Manitoba Opticians Act
  6. the expiry date of the certificate.

Certificate of Practice – Inactive Members

The registrar must issue a Certificate of Practice/License to an individual who is a member who is inactive and who applies for it and whose name is entered on the register of inactive members if all of the following are satisfied:

  1. the inactive member’s registration is not suspended or cancelled;
  2. the inactive member meets any requirements for Maintenance of Competency that are established by OOM policy;
  3. the inactive member pays the inactive fees provided for in the OOM bylaws;
  4. the inactive member provides the registrar with any other information that the OOM policies/bylaws require;
  5. the inactive member meets any other requirements set out in the OOM bylaws on Licensing- Change in Licensing Status –Inactive

Conditions

A Certificate of Practice/License may be issued subject to any conditions that the registrar considers advisable.

Information to be shown on Certificate of Practice/License

A Certificate of Practice/License under this section must include;

  1. the name of the regulated inactive member;
  2. the class of inactive membership, as the OOM has more than one class of inactive  members
  3. the name of the OOM as the regulatory body that is issuing the certificate/license, and the date it is issued;
  4. a statement that the Certificate of Practice/License is issued pursuant to the Province of Manitoba Opticians Act
  5. the expiry date of the Certificate of Practice/License.

Application not approved

If an application for a Certificate of Practice/License is not approved, or is approved subject to conditions, the registrar must

(a) give notice to the member in writing, with reasons for the decision; and

(b) advise the member of the right to appeal the decision to the council.

Appeal

A person whose application for a Certificate of Practice/License is not approved or is approved subject to conditions may appeal the decision.

Producing Certificate of Practice/License

A member who holds a current valid Certificate of Practice/License must, on request, make it available for inspection.

Displaying Certificate of Practice/License

A member who holds a current valid Certificate of Practice/ License must wear the Certificate/license in a conspicuous place on their clothing while on the premises in which the member conducts his or her practice. Members who fail to comply with this requirement will be subject to disciplinary action.

1 – “optician” means a person who(a) prepares and dispenses lenses, including contact lenses, spectacles, eye glasses and appurtenances thereto, or any of those things, to the intended wearers thereof on the written prescriptions of duly qualified medical practitioners or of the holders of certificates of registration under The Optometry Act; and (b) in accordance with such prescriptions interprets, measures, adapts, fits, and adjusts, such lenses, including contact lenses, spectacles, eye-glasses and appurtenances thereto or any of those things, to the human face for the aid of vision or the correction of visual or ocular anomalies of human eyes
